Welcome to Yelow. Please read on to learn the rules and restrictions that govern your use of our website(s), products, services, and applications (the “Services”).

These Terms of Use (the “Terms”) are a binding contract between you and Yelow. (“Yelow” “we,” and “us”). You must agree to and accept all of the Terms, or you don’t have the right to use the Services. Your using the Services in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use the Services.

Will These Terms Ever Change?

‍We are constantly trying to improve our Services, so these Terms may need to change along with the Services. We reserve the right to change the Terms at any time, but if we do, we will bring it to your attention by placing a notice on the Yelow.club website, by sending you an email, and/or by some other means.

If you disagree with the new Terms, you are free to reject them; unfortunately, that means you will no longer be able to use the Services. If you use the Services in any way after a change to the Terms is effective, that means you agree to all of the changes.

Except for changes by us as described here, no other amendment or modification of these Terms will be effective unless in writing and signed by both you and us.

What About My Privacy?

‍Yelow takes the privacy of its users very seriously.

‍We receive and store any information you knowingly provide to us. For example, if you submit a form through the “Contact” page, we will collect Personal Information such as your name and email address. Certain information may be required to register with us or take advantage of our features.

We may communicate with you if you’ve provided us with the means to do so. For example, suppose you’ve given us your email address. In that case, we may send you promotional email offers on behalf of Yelow or other businesses or email you about your use of the Services. Also, we may receive a confirmation when you open an email from us. This confirmation helps us make our communications with you more interesting and improve our services.

We may share and/or transfer account, contact, and other Personal Information in connection with the evaluation of and entry into such transactions. What Are The Basics Of Using Yelow?

You may be required to sign up for an account. You promise to provide us with accurate, complete, and updated registration information about yourself. You may not provide information that you don’t have the right to use or another person’s name with the intent to impersonate that person. You may not transfer your account to anyone else without our prior written permission.

You represent and warrant that you are of legal age to form a binding contract (or if not, you’ve received your parent’s or guardian’s permission to use the Services and gotten your parent or guardian to agree to these Terms on your behaSuppose). d. Jeopardizes the security of your Yelow account or anyone else’s (such as allowing someone else to log in to the Services as you);

e. Attempts, in any manner, to obtain the password, account, or other security information from any other user;

f. Violates the security of any computer network or cracks any passwords or security encryption codes;

g. Runs Maillist, Listserv, any form of auto-responder or “spam” on the Services, or any processes that run or are activated while you are not logged into the Services, or that otherwise interfere with the proper working of the Services (including by placing an unreasonable load on the Services’ infrastructure);

h. “Crawls,” “scrapes,” or “spiders” any page, data, or portion of or relating to the Services or Content (through use of manual or automated means);

i. Copies or stores any significant portion of the Content;

j. Decompiles, reverse engineers or otherwise attempts to obtain the source code or underlying ideas or information relating to the Services.

‍A violation of any foregoing is grounds for termination of your right to use or access the Services.

What Are My Rights In Yelow?

‍‍The materials displayed or performed or available on or through the Services, including, but not limited to, text, graphics, data, articles, photos, images, illustrations, User Submissions (defined below), and so forth (all of the foregoing, the “Content”) are protected by copyright and/or other intellectual property laws. You promise to abide by all copyright notices, trademark rules, information, and restrictions contained in any Content you access through the Services, and you won’t use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any purpose any Content not owned by you, (i) without the prior consent of the owner of that Content or (ii) in a way that violates someone else’s (including Yelow’s) rights.

You understand that Yelow owns the Services. You won’t modify, publish, transmit, participate in the transfer or sale of, reproduce (except as expressly provided in this Section), create derivative works based on, or otherwise exploit any of the Services.

The Services may allow you to copy or download certain Content; please remember that just because this functionality exists, doesn’t mean that all the restrictions above don’t apply – they do!

Who Is Responsible For What I See And Do On The Services?

‍‍‍‍Any information or content publicly posted or privately transmitted through the Services is the sole responsibility of the person from whom such content originated. You access all such information and content at your own risk. We aren’t liable for any errors or omissions in that information or content or for any damages or loss you might suffer in connection with it.

We cannot control and have no duty to take any action regarding how you may interpret and use the Content or what actions you may take as a result of having been exposed to the Content, and you hereby release us from all liability for you having acquired or not acquired Content through the Services. We can’t guarantee the identity of any users with whom you interact in using the Services and are not responsible for which users gain access to the Services.

Yelow has no control over and assumes no responsibility for the content, accuracy, privacy policies, or practices of or opinions expressed in any third-party websites or by any third party you interact with through the Services. In addition, Yelow will not and cannot monitor, verify, censor, person’s sole responsibility or edit the content of any third-party site or service. By using the Services, you release and hold us harmless from any and all liability arising from your use of any third-party website or service.

Your interactions with organizations and/or individuals found on or through the Services, including payment and delivery of goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such organizations and/or individuals. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties. You agree that Yelow shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings.

If there is a dispute between participants on this site, or between users and any third party, you agree that Yelow is under no obligation to become involved. In the event that you have a dispute with one or more other users, you release Yelow, its officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or our Services.

What does Yelow do?

By accessing or using any Services, including without limitation by downloading, installing or using any associated software, APIs, plugins or apps supplied by the Company, including any for which the purpose is to enable you to use the Services (collectively, the "Software,” which is considered a part of the Services), you agree to the terms of this Agreement. Any reference to the “website(s),” the “web site(s),” the “site,” “www.Yelow.club”, or other similar references shall include any and all pages, subdomains, affiliated domains, brands, products or other areas of our website, or any other affiliated sites or domains owned or operated by or on behalf of us, plus any of the online content, information, and services as made available in or through the website. The Services include without limitation all aspects of the website or of any app or other product or service, including but not limited to all products, Software and other applications, features, channels and services offered therein. Any reference to “content” shall include all content in all forms or mediums, such as (without limitation) text, software, scripts, graphics, photos, sounds, music, videos, audiovisual combinations, interactive features and other materials you may view on, access through, or contribute to the Services. ‍

You may need to register with us to access and use some of our Services. You must not initiate or participate in any activities on our Services that are illegal, harmful, or interfere with anyone's use of our Services, including without limitation.

The Service includes, among other things, a search, directory, and purchase platform for enabling the connection between individuals seeking to obtain certain third party products and services (“Third Party Products”) from certain individuals or companies (“Third Party Product Providers”) seeking to provide Third Party Products to consumers or other end users, and we merely help facilitate that independent, third party transaction.

The Company is merely a facilitator, and does not make the Third Party Products, and therefore does not guarantee or warrant, and makes no representations regarding, any Third Party Products and/or Third Party Product Providers, including without limitation regarding the reliability, quality, safety, cost, appropriateness, or suitability thereof, nor that the applicable Third Party Product Provider has the rights to sell such applicable Third Party Products to you. We may be acting as your agent, making transactions on your behalf. In such case, you are responsible for such transactions. We will endeavor to work within the scope of your authority. We reserve the right to charge transaction fees and/or service charges for providing this Service, and you agree to pay them. For certain transactions, we may not know the final price of the applicable Third Party Product to be charged to you by the Third Party Product Provider, including, e.g., all taxes and shipping costs, and all transaction fees and service charges, etc., until after you have agreed to purchase and/or consummated the purchase. You consent and agree to this and remain responsible for your purchase instructions even if and when the final price so differs.

Although you are buying from the Third Party Product Provider (subject only to any warranties they offer, if any), we may be listed as the ‘merchant of record’ on your credit card statement; you expressly acknowledge and agree that does not negate any of the provisions herein, including without limitation that the Third Party Product Provider, and not us, is liable for any problems or issues with, and/or any disputes over, the Third Party Products, including without limitation, warranty issues, failure to deliver, delays in delivery, damage during delivery, etc.

If and when you click to share or use the Service, you are consenting to allow us to perform the requested actions, including without limitation, as applicable, consenting to allow us to access your camera, your photos, your browser, your social media accounts, and other locations from which you initiate transactions, your other relevant accounts and subscriptions, and any content, metadata, or images therein or associated therewith, to perform the Services. You are responsible for following any and all applicable rules of any such third parties.

We reserve the right to determine, in our discretion, how the Service determines which Third Party Product Provider to use once you have selected a Third Party Product to buy. We may offer you options, such as, without limitation, prioritizing vendors you have used before, fastest to ship, lowest cost, or other parameters.

Neither the company nor its affiliates or licensors is responsible for the conduct, whether online or offline, of any user of the service or third party products nor any third party service providers. The company and its affiliates and licensors will not be liable for any claim, injury or damage arising in connection with your use of the service or the third party products.it is up to the third party service provider to offer their third party products. The company offers information and a method to obtain such third party products from third party service providers, but does not, and does not intend to, provide third party products or act in any way as a third party service provider, and has no responsibility or liability for any third party products provided by (or failed to be provided by), nor for the actions or inactions of, any third party service providers. Any individuals who provide any third party products are not employees nor contractors of company but rather of third party service providers, and company is not responsible for their actions or inactions.

Who governs the payment policy at Yelow?

What about issues in Delivery and product quality?

We help you to process the order with the best offers quickly. We are there to help with all of your deliveries and product issues, but we don't accept any legal binding for loss because the delivery is still taken care of by the platform on which you used Yelow to check out quickly. Any legal proceeding should be against the merchants and not with Yelow for delivery and product issues.

What about cancellations and refunds?

We help you to process the order with the best offers quickly. We comply with the cancellation & refund policy of the merchants you place the order with. We will help you with the cancellations and refund but do not take any guarantee of the cancellations. We don't accept any legal binding for loss because the cancellations and refunds are still taken care of by the platform on which you used Yelow to check out quickly. Any legal proceeding should be against the merchants and not with Yelow for cancellation and refund issues.

Will Yelow Ever Change The Services?

‍‍‍We’re always trying to improve the Services so that they may change over time. We may suspend or discontinue any part of the Services, introduce new features, impose limits on certain features, or restrict access to parts or all of the Services. We’ll try to give you notice when we make a material change to the Services that would adversely affect you, but this isn’t always practical. Similarly, we reserve the right to remove any Content from the Services at any time, for any reason (including, but not limited to, if someone alleges you contributed that Content in violation of these Terms), in our sole discretion, and without notice.
